Terms and Conditions of The Pottery

1. Preamble: 

1.1. The Pottery contracts solely on the basis of these Terms and Conditions. 

1.2. The applicability of any general terms and conditions of The Pottery's customer is excluded. Any general terms and conditions of The Pottery's customer are therefore rejected.

1.3. By booking an afternoon tea appointment, the customer acknowledges The Pottery's General Terms and Conditions and Terms of Use.

1.4. The General Terms and Conditions are available on The Pottery’s website and at The Pottery’s store.

1.5. It is important to note, that the premises are not barrier-free due to the historc nature of the building. 

1.6. The current prices and times can be found on The Pottery's website. The on-site shop is only open and accessible during the booked afternoon tea sessions.

1.7. Prices are quoted in euros unless expressly agreed otherwise. Due to the small business regulations, no sales tax is charged (sales tax exempt). The prices publicly displayed in the store or on the website apply unless expressly agreed otherwise. The Pottery assumes no liability for typesetting or printing errors in the store or on the website.

1.8. The customer must note that the premises are only available for the booked time and that earlier entry will not be granted.

1.9. In the interest of all users, The Pottery reserves the right to deny access to persons whose entry to the premises appears questionable (e.g. due to intoxication, aggression, etc.).

1.10. If the customer fails to comply with the Terms and Conditions, house rules, and/or instructions, The Pottery reserves the right to remove the customer, their accompanying person, or parents from the premises and terminate the contract. In this case, the customer will not be refunded any fees.

2. Rules of conduct: 

2.1. The instructions of The Pottery and its employees must be followed at all times.

2.2. Persons who violate the Terms and Conditions and/or the house rules and/or instructions will be immediately expelled from the facility.

2.3. Bringing pets is not permitted.

2.4. The premises of the business and the afternoon tea venue are under video surveillance. Any theft will be reported to the police without exception.

2.5. Customers and accompanying persons must ensure mutual consideration.

2.6. Bringing food/snacks is not permitted.

2.7. Smoking is prohibited throughout the entire (residential) complex, in the rooms, in the courtyard and in the toilet area.

2.8. The entire complex and its facilities may only be used for their intended purpose.

2.9. Entering rooms, staircases, entrances and apartments that do not belong to the company is strictly prohibited.

2.10. Parents are responsible for their children. The Pottery provides no supervision.

3. Warranty and liability:

3.1. The Pottery is not responsible for any success in the service provided. Failure to improve performance shall not be considered defective performance.

3.2. Use of the premises is at your own risk.

3.3. The Pottery only maintains the premises in a usable condition.

3.4. Use of the coatrack is at the customer's own risk. The Pottery assumes no liability for lost items, clothing, etc.

3.5. The customer is liable for any damage caused by the customer and the customer’s children.

3.6. In case of serious soiling, the customer must pay a cleaning fee.

4. Booking conditions:

4.1. Confirmed afternoon tea bookings cannot be canceled. A refund of the purchase price is not possible. However, the booking can be transferred to another person. To do so, the booking confirmation must be presented upon arrival.

4.2. For organizational reasons, transacted bookings cannot be rebooked to other dates. 

4.3. Sessions must be paid at the time of online booking, in advance of the afternoon tea appointment.

4.4. Customers who book afternoon teas accept the booking conditions listed under point 4.

4.5. In the event of cancellation of the afternoon tea session for any reason, there is no entitlement to a full or partial refund of the price.

5. Warranty and return of products purchased in the local shop at The Pottery: 

5.1. Within the scope of the warranty, The Pottery is only liable for those defects in a purchased product that were already present at the time of handover. New defects in a sold product that arise after handover are therefore not covered by the warranty. The warranty period for movable products is two years.

 

5.2. Products purchased in-store at The Pottery are non-refundable. There is also no right of return.

6. Severability clause

6.1. Should any provision of this agreement be invalid or unenforceable in whole or in part, the remaining provisions of this agreement shall remain in full force and effect. The invalid or unenforceable provision itself shall be replaced by the statutory provision. If no statutory provision exists, the matter shall be resolved by applying a similar legal principle, taking into account the principle of good faith; in particular, the invalid or unenforceable provision shall be replaced by a valid or enforceable provision that comes as close as possible to the economic intent of the invalid or unenforceable provision. This also applies to any gaps in this agreement.
